Are Hasan Ba Shuaib and Yusuf al Jazairee from the scholars of Jarh wa Ta'deel ?

Are they from the scholars of Jarh wa Ta'deel ? And what is your advise for those who spread their refutations and cause Fitna and splitting among the Salafis ? May Allah reward you. </blockquote> <h3>Answer : </h3> Wa alaikum salam warahmathullahi wabarakathuhu . The answer is : My noble brother.. may Allah give us and you Tawfeeq towards that which He loves and is pleased with Know that a lot of speech related to Dawah from those whom you mentioned in your question are clear evidences for the just and rational ones that those people whom you mentioned are not qualified to come forward in the name of Dawah and defending it. And the reality is the best witness.... rather the reality of the likes of these people is that they are a burden and hardship upon the Dawah and its (true) people. So the path that these people and their likes from the extreme ones traverse upon is considered to be a crime towards Salafiyyah and its people since it is an intellectual mistake which has occurred because of a wrong understanding regarding the definition of Salafiyyah... rather (regarding the definition of) Ilm fundamentally. And this is from a lot of perspectives. For example they are narrow minded as they look at things from only one perspective and they apply them in only one way . That's why they don't look at the endings and the results of things and their types from which dangerous things normally happen such as making Tabdee upon the people as a whole and individually without any distinction . Likewise from them is stripping off the foundations of the Shariah and its branches from how the scholars practically applied them i.e stripping the understanding of Salafiyyah from the methodology of its scholars . That which arises from this is concealed desire (Hawa) in the way of practicing Salafyyah by name of Salafiyyah ! This is why you see them being very decisive in issues in which difference of opinion among the scholars have become prevalent and famous due to the strength of (all of) the opposing and differing sides regarding the issue. It is as if they attained knowledge more than all of the Ulemah before them ! So you will find them lot of times being fervent to throw away the other opinion based on what they believe no matter how (strong and) heavy the other opinion is on the scales of the Ulemah . And absolutely this is not way of the Ulemah. This is why you find Fataawa from these people in complex issues in which it is befitting for the (true) scholar to wait ( and not to proceed quickly to give Fatwa ) and even if he proceeds he should not be decisive (regarding his Fatwa). He gives the Fatwa along with good manners , reverence and utmost humility because of the severity of the differing . But as for these people , then (their Fataawa in these issues) are quick answers that are (very) short and decisive and sometimes they are only half a line ! . So don't think that this is a path to knowledge, rather it is an evidence of a lack of correct awareness regarding the path of the people of knowledge. And the amazing thing is that this according to their blind followers is a sign of real Ilm ! We wish had it been true that Ibn Abdil Barr , Ibn Hazm , An Nawawee , Ibn Qudama and Ibn Taymiyya learnt this way so that they could have summarised all those large number of volumes into small booklets upon the way of " permissible and not permissible " of Hasan Ba Shuaib ?! Know my brother that this type of education does not create a real student of knowledge but rather fanatic blind followers who are not upon firm foundations and proper qualifications because they are blind from the realities of Dawah and the legacy of the Ulemah . And they don't see the knowledge except in the statements of their Shayk most of the times whom they are fanatic towards ! And "most of the time" when these people study the matters of Khilaaf they don't adhere to the proper manners of the Khilaaf i.e. they study about the differences of opinions in a specific matter whilst not adhering to the proper manners (of how to deal with the people who hold the other opinion) . Therefore they do not treat the one who has a different view in the right way as they don't give them the station that is necessitated by the scales of the (true) Ulemah because they concluded its futility in the first place even if it is the view of the majority of scholars ?! Also from that is a narrow perspective and short sightedness which leads to a hypothetical reality that does not exist except in the minds of these people . Because of this you find them that they deem everyone who opposed them to have opposed the entire Ahlus Sunnah wal Jamaa' and entire here means all of the Ahlus Sunnah since they were first created . And the reason for this is their delusion that they alone are the Ahlus Sunnah apart from the rest of mankind . Rather you see them necessitating that they are the firmest of people and the purest and the most intelligent and the most knowledgeable etc. sometimes directly and sometimes in an indirect way. Not to mention interfering with people's intentions and magnifying that which should be simply neglected and going to extremes in places of pardoning and being hasty in places of forbearing ! ..also having a sharp tongue and ugly descriptions that which the people of good manners would avoid . May Allah protect us and you from it . So the one whose situation is like that it is not befitting that he is described as having shares in terms of Knowledge and Dawah because in reality he is someone who destroys .. not to mention that he is described as a scholar.. let alone that he is described as a scholar in a branch from the branches of the Shariah which requires something more than just describing him as a mere scholar i.e something more from piety , knowledge and acquaintance with situations and their endings and a complete knowledge regarding the various chapters of Maslaha and Mafsada and a full experience or say enough experience with the Manhaj of the Ulemah in dealing with the opposers and the qualification to apply it in the correct way in the real Dawah situation . The summary is that , Salafiyyah has become in the east and these people are in the farthest west and how far is the distance between the east and the west and how far is the distance between them and the true Salafiyyah ! May Allah guide all of us . As for the one who spreads (the speech) of these people and he has some goodness in him then you don't have to do anything.. since he will see from them what is going to make him awake sooner or later . Since these people are like live coal that burns whatever it falls upon and even if they don't find anything to burn they will still burn themselves like the one who makes his two legs fight each other . Rather , I would like to mention that once I counted along with a brother in Indonesia those Masaajid which follow these people's opinions .. we were not able to find one Masjid among these Masaajid that were safe from differing , splitting and insulting one another by doing Tabdee after they were brothers loving each other ... so there was not even one Masjid that was safe when we tried to count ! Because those people were rushing to practice such things on each other before counselling with the true Ulema . And events happen one after another during which lot of brothers like this wake up (and see the reality) . And Allah is the one whose help is sought.

Is there any difference between the Fiqh of Ahlul Hadith wal Athar and the Fiqh of the Madhaahib ? 

Is there any difference between the Fiqh of Ahlul Hadith wal Athar and the Fiqh of the Madhaahib ? Is there anything special about Imam Albani and Imam Shawkani etc. compared to other contemporary scholars like Imam Ibn Baz , Ibn Uthaymeen.. when it comes to Fiqh ? Some people say the latter two are Salafis in Aqidah but Hanbalis in Fiqh whereas the former two are Salafis or Ahlul Hadith wal Athar in both Fiqh and Aqidah . These brothers follow Fatwas of Imam Albani , Imam Shawkani etc. in most of the issues and when we present the Fatwas of scholars like Ibn Uthaymeen , Ibn Baz they say ' these are Fatwas based on the Hanbali Madhab.. ' so as to make it seem like they have lesser weight . Also these people claim , scholars like Shayk Albani are Muhaddithoon but scholars like Shayk Ibn Uthaymeen are only Fuqahaa and they say Muhaddithoon understand the Hadiths better than the Fuqahaa. Can you please clarify whether these type of statements are correct ? 

Is pure Salafi Dawah present only in Yemen ? A refutation for the digressions of some beginners regarding the Salafi Dawah in Yemen

Because some students of knowledge in Yemen..</blockquote> <h3>I say :</h3> Perhaps , rather these are digressions from some of the beginners and the impulsive ones. There is no consideration to the words of such people. Rather , consideration is only for the statements of those who speak in the name of the Dawah , and these impulsive ones are not from them. Most of the statements mentioned in your question are of this kind , so be aware of that . But yes , it is obligatory for those Sheikhs ( who are in charge of these beginners ) to spread the correct understanding among them in order to save the Dawah from many negative consequences that result from the tampering of these impulsive beginners . <blockquote>The statement : ( The Victorious Sect is in Yemen )</blockquote> <h3> I say :</h3> The Victorious Sect exists where ever the people of Hadith are found , the people of the Sunnah , and they are the people of knowledge and correct practice , whether they are in Yemen , Najd , Hijaz or China , without specifying a country, tribe or race etc. <h3>Benefit :</h3> The Hadith in which the Victorious Sect was specifically mentioned to be foudn in a particular place is the Hadith of Abu Umamah in which ( They said : O Messenger of Allah , where are they ? Then he replied : in Baitul Maqdis ) . It is an addition to the original authentic Hadith , and the scholars have judged it as a weak addition . <blockquote>The statement : ( The truth is in Yemen )</blockquote> <h3>I say :</h3> The truth of what ?! If you intend the truth of the Victorious Sect , the statement has been cleared in what preceded before . And if you intend that the true Salafiyah is in Yemen only , it will be cleared in what comes after ! And if you intend the truth of Religion , then it is in the Book of Allah عز وجل and the Sunnah of His Messenger صلى الله عليه وسلم . And if you intend ……? Clarify what you intend.. May Allah عز وجل rectify us and you . <blockquote>The statement : ( The Salafi Dawah in Yemen is the only pure Salafi Dawah in the world )</blockquote> <h3>I say :</h3> We have repeatedly stated that the Salafi Dawah in Yemen , its goodness are numerous , and it is a point of pride for every Salafi in this world . However , such exclusive claims bring greater harm than benefit to the Dawah . Also there is no textual or logical evidence to prove such claims rather the evidences and the reality reject such exclusive claims for example : <ol><li>Restricting truth and guidance in this way requires clear , authentic texts from the Kitab and the Sunnah which cannot be understood in a different way , so where are they ?!</li><li>There is no clear research based on the principles of knowledge based researches by the scholars in Yemen regarding this issue. Rather , these are judgments from some people which are based merely on emotions </li><li>The acknowledgment by many of the Mashayk in Yemen that there are Salafi Scholars and Salafi Duaat in the world in places other than Yemen !</li><li>Who has traveled around the entire world and analysed the conditions of the scholars and callers there so that he can be certain of a statement like this ?</li></ol> Rather , the claims and speech for which there is no proof do not even deserve to be discussed let alone spending time in refuting them ! <blockquote>The statement : ( Many Saudi scholars have become Ikhwani innovators )</blockquote> <h3>I say :</h3> This is another mere claim like the previous ones . For the Mashayk - Abdul Aziz bin Abdullah Aala Sheikh , Saleh bin Fawzan Al-Fawzan , Abdullah Al-Turki , Saleh Al-Suhaimi , Saleh bin Humaid , Saleh Al-Usaimi , Saad bin Nasser Al-Shethri , Muhammad bin Hasan Aala Sheikh , Abd al-Muhsin al-Badr , Abd al-Salam as-Sulaiman and many others , all of these are from the students of Shayk Ibn Baz رحمه الله and other scholars who preceded us and they are testified to for their knowledge and Salafiyyah . And indeed , almost every one of them has atleast one clear and detailed statement warning against Hizbiyyah and Ikhwaniyyah in particular , and other than that . As for those issues in which they did Ijtihad and erred then this happens to every Mujtahid and a scholar , and no one is free from it except the Prophets ! <blockquote>The statement : ( We can find the Saudi scholars strong in Aqidah , Fiqh etc .. but when it comes to Ilmul Rijaal , then we have to take it only from the scholars of Yemen )</blockquote> <h3> I say :</h3> This is also a mere claim like the previous ones , and in addition it has a contradiction . Because being strong in Aqidah , Fiqh etc. necessitates strenght in one's Deen and Knowledge and that includes the ability to distinguish guidance from misguidance ( pertaining to the people ) , otherwise it is not a strength as you mentioned ! So the claim of being strong in Aqidah and Fiqh whilst at the same time negating strength in Manhaj is rejected . Rather being strong in Aqidah and Fiqh is an evidence of the correctness of the methodological principles which a person should rely upon during his journey towards Allah عز وجل and being so is synonymous to steadfastness upon the truth. <blockquote> The Questioner : And much more (statements) </blockquote> <h3>I say : </h3> No problem .. bring them and let us clarify ... <blockquote> Also explain how many scholars are in Yemen ?</blockquote> <h3>I say :</h3> Only Allah عز وجل can enumerate them and describing a person as 'Scholar' is only relative like Allah عز وجل said ( وَفَوْقَ كُلِّ ذِي عِلْمٍ عَلِيمٌ ) ( And above every knowledgeable person is someone who is more knowledgeable ) . So Allah عز وجل knows best . <blockquote> Is everyone who is called a Sheikh considered a scholar ?</blockquote> <h3>I say : </h3> No and yes . And this needs explanation . <ol><li> If you mean by " Scholar", i.e. the scholar of the Ummah who lead the people as the ruler leads the people , then the answer is “No” since this is a specific attribute for the one who fulfills a lot of conditions , which include things he does not have any power over like making the entire Ummah accept him ( as a scholar ) and being pleased with him and things which he has power over like he should have spent most of his life in learning the rulings of the Sharia in a detailed manner in so as to educate himself first and then the people regarding the rulings and aspects of the Shariah.</li><li> And if you mean by "Scholar" , the one who answers whilst being asked by those who do not know in order to know the rulings of their religion then we say "Yes" and the attribute "scholar" here becomes synonymous with "people of remembrance " as in the saying of Allah عز وجل : ( فاسألوا أهل الذكر إن كنتم لا تعلمون )</li></ol> ( So ask the people of remembrance if you do not know ) . Therefore he is a scholar relative to those people around him who learn from him . But he is not from those who are called 'scholars' from the first perspective . May Allah عز وجل bless you. And Allah عز وجل knows best .
