Breaching the contract because of a delayed payment

We got a client through a contracter and there was a silent agreement with the contracter that we will not do business directly with the client . The service for the client is complete but the contracter is delaying the payment for us and not accepting our calls . Now the client has come into contact with us directly seeking a new service and they say they no longer want to work with this contracter . Now is it allowed for us to work with the client directly as the contractor has not fulfilled the agreed terms of payment for the previous services ? Will this be a breach of Amaana ?
